With your consent, Earna captures precise location data by accessing your device's GPS to deliver Services tailored to your whereabouts, including alerts on proximal rewards partners. This feature can be deactivated at any time through your device's location service settings, allowing you full control over your privacy preferences. Additionally, upon opting in, Earna can send push notifications to your device, encompassing welcoming messages, insights into product features, and exclusive promotional offers. Preferences for receiving these notifications can be adjusted by disabling push notifications for the App in your device's settings, ensuring a personalized user experience.
The mobile app necessitates the collection of minimal device and usage information, such as device type, operating system, unique identifiers, IP address, language settings, and app access timestamps, to facilitate optimal functionality and an enhanced user experience. This data assists in analyzing app engagement levels, enabling continuous improvements to the app's performance and the personalization of content within the app. To further refine our offerings, Earna may employ third-party Services to gather analytical insights regarding app feature usage and engagement duration.
Earna is committed to maintaining transparency regarding the collection, utilization, and sharing of information within the constraints imposed by external platforms like Apple and Google. While we strive to clearly communicate our practices, it's important to recognize that certain tracking activities by these platform providers or your telecommunications carrier fall outside our jurisdiction. We advise users to thoroughly review and understand the privacy policies of any third-party providers, including those related to Android and iOS apps, as well as those of their telecommunications provider, before proceeding with any app downloads or making any purchases, ensuring a well-informed app interaction and purchase decision-making process.

To access most financial products and Services we offer you need to have an Earna profile. In order to create it, we collect your email address, phone number, and a password that you select. We use this information to administer and authenticate your access to our platform, to enable you to access products and Services, and to update you about changes to our platform.
Other information we collect directly from you on or through our Website or mobile application may include:

Records and copies of your correspondence (including email addresses), if you contact us.
If you submit the contact details or identification information of another individual (for example, a counterparty or an authorized user), we may gather their full name, email, and telephone number (including, for business-related contacts, the name of the recipient and their account details.
If you apply for a credit product, including but not limited to Earna Credit Cards, we may collect additional financial and personal information to assess your creditworthiness and confirm your eligibility. This may include details about your income, housing situation such as move-in date and whether you rent, own, or live with family, housing costs, and living expenses such as utilities. We may also collect your employer’s name, monthly credit or loan obligations, and source of income. We may perform credit checks to determine your eligibility and applicable credit limits. If you are approved and possess an Earna profile, we will use your financial and transactional information, including card and account usage, payment history, and transaction participants, to provide the financial products and services you have obtained and to deliver relevant account information. We may also contact you with important updates and useful information about your financial accounts using your phone number, email address, or mailing address, through methods such as mail, email, SMS where standard rates may apply, push notifications, or direct phone calls.
Sponsoring Bank and Payment Networks
Your Personal Information may be disclosed to certain third parties as part of specific financial products or Services that you apply for, are approved for, and participate in.
When you apply for, receive approval to use, or use one of our credit cards, we may disclose your contact, identity, financial, transaction, online, counterparty, and third-party information with our subsidiaries and affiliates and authorized third party responsible for issuance of our cards, including Equitable Bank. We provide this information only to the authorized parties necessary for the purposes of regulatory reporting, compliance and to inform if we can onboard you as a customer for these products. Our authorized third parties may collect, use, disclose and otherwise handle your Personal Information according to their privacy policies. The card sponsoring bank’s handling of your Personal Information is subject to their own privacy policy and is not governed by this Privacy Policy. Additionally, we collect from and share your Personal Information to, payment networks (such as Visa*), card processors, acquirers, card manufacturers, and mobile wallet providers (such as Apple Pay, Google Pay, or Samsung Pay) for purposes such as: Processing card transactions; Supporting mobile wallet provisioning and security; Detecting and preventing fraud; Complying with card network rules and regulatory obligations; Supporting tokenization services and transaction routing; Facilitating dispute resolution and chargebacks.
These partners may process your information outside of Canada, and we ensure that contractual safeguards are in place to protect your information in accordance with applicable laws.
Where we store your information
Personal Information you provide to us is stored in the following locations: in any provinces of Canada, including Quebec, the United States and the Philippines.
The degree of sensitivity of each of these storage sites has been established. All Personal Information stored there is adequately secured and access to them is restricted to authorized persons only.
When we transfer your information to other jurisdictions, including to jurisdictions outside of the province in which you reside (which may include transfer outside of Quebec for Quebec residents) and outside of Canada, it will be subject to the laws of that jurisdiction and may be disclosed to or accessed by the courts, law enforcement and governmental authorities in accordance with those laws. We contractually require these third parties to keep Personal Information confidential and use it only for the purposes for which we disclose it to them. To be able to offer and administer our products and Services, we may share your Personal Information to the card manufacturer to be able to manufacture your card and with a payment processing business, or with print suppliers to be able to provide you our product and Services.
To our insurance partners to the extent that it is required to provide our Services.
To third party credit reporting agencies for business purposes that include but are not limited to: investigating and monitoring of internal business practices, providing and supply of Services to you; for research, testing and development of products offered by the Company; to detect security breaches and protect against them. Were any of the following to be carried out, prior to any disclosures of Personal Information, a contract would be entered into that will ensure the protection, security and use for the above-mentioned purposes between us and any third party.

The use of the collected data
We collect and use Personal Information for purposes limited to those related to our businesses, which include providing Services to our customers and as otherwise disclosed in this policy. We collect Personal Information primarily from you, for instance through applications and supporting documentation you provide. We may retain phone logs and meeting notes for quality assurance training and record keeping purposes. We may use the collected data for the purpose of responding to requests made pursuant to this Privacy Policy, including for verification purposes. We may also collect Personal Information about you through your ongoing interactions with us, from references, employers, and other financial institutions you have identified in your application as well as credit bureaus and other third-party sources.
Anti-Money Laundering and Sanctions Checks
When you apply for financial products and Services offered by us, we use service providers to meet our regulatory obligations regarding anti-money laundering and sanctions. We review the final result of anti-money laundering checks in order to comply with applicable legal and regulatory obligations (including those relating to money laundering, terrorist financing and financial dealings with certain sanctioned individuals).
Third Party Accounts
If you consent and provide account details for bank accounts with other financial services providers in order to fund your account or access our Services, we collect information about this bank account, including financial institution name and number, account number, transit number, and account balances from a service provider, such as Flinks, to facilitate these transactions.
Credit Checks
When you apply for certain financial products and Services offered by us, we collect, share and disclose identity information and financial and transactional information from and to third parties (including screening Services, telecom providers and credit reporting agencies, such as TransUnion and/or Equifax).
We use your name, address, SIN, and date of birth to obtain certain credit, financial, personal, and business information contained in your credit report, to the extent provided by a credit bureau, for the purposes of verifying your creditworthiness, assessing, and managing our credit risks, establishing credit and hold limits, qualifying you for other products and Services, and detecting and preventing fraud and other decisions about your account. We may also share information with credit reporting agencies on an ongoing basis in order for the credit reporting agencies to maintain accurate credit information within their databases, in accordance with applicable laws.
Additionally, we may share your information with credit reporting agencies on an ongoing basis to maintain the accuracy of credit records in compliance with applicable laws.
We may also collect and exchange Personal Information with consumer and credit reporting agencies regarding negative information such as late payments, missed payments, or defaults. This consent remains effective as long as your Earna account is active.

By submitting a credit application with Earna, you authorize us to collect, use, disclose and process your credit information for the purposes outlined above in accordance with applicable laws and regulatory requirements.
Bank Account Connection
To verify your identity, assess your application, and set up payments, we may ask you to connect your bank account through our third-party service providers, Flinks Technology Inc. ("Flinks") and Plaid Inc. ("Plaid"). You will be asked to enter your online banking username and password directly into an interface operated by Flinks or Plaid. Your credentials are held by Flinks or Plaid under their own privacy policies. Earna does not receive or store your online banking username or password. Once connected, we receive information from your financial institution such as your account number, balances, transaction history, and account holder details. We use this information only as described in this Privacy Policy.
Before you connect your account, please review your agreement with your bank, credit union, or other financial institution to determine:
whether you are permitted to share your online banking login information with a third party;
the consequences of sharing that information; and
any liability you may have for losses resulting from sharing that information.
You are responsible for reviewing your agreement before deciding to proceed.

Rights and Personal Data
We allow you to manage your account and information you provided. Once you log in, you may update your Personal Information, if your account is in good standing and hasn’t been deactivated. In that case, we will retain only the Personal Information required by law or that we deem necessary to fulfill the purpose for which it was collected.
We may not be able to provide access to some or all individual’s Personal Information.
Reasons for refusing access may include situations where:
The release of the Personal Information may threaten the life or security of a third party;
Personal Information is unreasonably costly to provide;
The request is frivolous or vexatious or made in bad faith;
Personal Information is subject to, or generated in a formal dispute resolution process;
Personal Information cannot be disclosed for legal, security, or commercial proprietary reasons; or
Personal Information is subject to solicitor-client or litigation privilege.
All information provided can be used in legal proceedings and/or in a Court of Law having jurisdiction if deemed necessary. Additionally, we will release any information if mandated by local, provincial, or federal laws and/or their officers.
Withdrawing Your Consent (i.e. “opting out”)
Should you choose to withdraw your consent that permits us to process your Personal Information, please indicate for which purpose(s) you wish Earna to stop processing your Personal Information (e.g., for a particular purpose, or for all purposes).
Prior to fulfilling your request, we may inform you of any consequences that withdrawing your consent may have in relation to receiving Services pursuant to this Privacy Policy. Please note that withdrawing your consent is not the same as requesting that we delete any Personal Information, and we may continue to hold your Personal Information pursuant to any business (e.g., retention) or legal requirements where deletion has not also been requested.
In some cases, withdrawing your consent is not an option because of legal or contractual requirements. If you have authorized us to disclose your credit repayment habits to credit reporting agencies as part of a loan/card you have requested, you won’t be able to withdraw this consent until you have fully repaid your loan/balance.
If you refuse to allow us to collect or process certain Personal Information, we may not be able to provide you with the product or Services requested and with certain benefits and discounts associated with that product or service.
For example, if you don’t allow us to consult your credit report when you apply for a credit product, such as a card or loan, we may not be able to provide you with the requested product.
Destruction and anonymization of Personal Information
You have the right to request the deletion of certain Personal Information after the initial purpose of providing them to us has been fulfilled. By law we must store your Personal Information provided for the initial purpose for a specific minimum period of time. Should there be a dispute or investigation initiated on your Account, the time we must retain information will be extended.
Should you wish to have your Personal Information deleted, provided that we are not mandated by law to retain them or if necessary to fulfill legal, contractual, and business obligations, you may send us a request detailing what kind of information you would like us to delete to Earna’s Privacy Officer at [email protected].
Once the retention period has expired, we ensure that your Personal Information is safely disposed of or de-identified. While deletion is a final and irreversible disposal process, de-identification means that your Personal Information is altered so that it can no longer directly or indirectly identify you. Deletion and de-identification are carried out in a safe and secure manner, in accordance with our internal policies.

to maintain records for credit reporting and dispute resolution.

You will be informed every time we are unable to fulfill your request in writing within 30 days of receipt of your request.
All requests for de-identification and deletion of Personal Information, with the actions taken, will be recorded in the dedicated tracking system. We are obliged by law to keep those records for at least 7 years since the request was submitted.
Safeguards
The security of your Personal Information is very important to us. We use physical, electronic, and administrative measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. We store all information, including Personal Information, you provide to us behind firewalls on our secure servers.
Personal Information will be protected by reasonable security safeguards appropriate to the sensitivity of the data collected. Access is restricted to personnel who are authorized as part of their duties. This information will not be made public, sold, or shared with third parties without your consent, except to ensure the service you've registered for or to meet legal obligations.
We are committed to providing the highest level of training as far as protection of your Private Information can go, every employee that may have access to your data is properly trained periodically.
We will protect Personal Information disclosed to third parties by means of contractual agreements with respect to the confidentiality of the Personal Information and the purposes for which the Personal Information is to be used.
We follow a compliance program to ensure that our systems and infrastructures are securely controlled and effectively operated. Controls are reviewed regularly to ensure operating effectiveness and security.
We have implemented processes to respond to data subject requests and complaints in a timely and effective manner.
We have implemented a framework for the retention and destruction of Personal Information to ensure compliance with legal obligations, and to securely destroy Personal Information once no longer required.
Children Under the Age of 14
